HC allows 3,000 class XI students to continue studies

CHANDIGARH: In what will be a huge relief to more than 3,000 class XI students, who were demoted to class IX by the school education board of Haryana, the Punjab and Haryana high court on Tuesday clarified that these students should continue with their studies unhindered till further orders.

The relief for the students came during the resumed hearing of the case before the high court on Tuesday, when the school education board said that it would not proceed against the petitioner-schools for not filing complaint against the students for forgery. The relief for the students would continue till August 13 when the case would come up for further hearing.

The matter has reached before a vacation bench of the high court in the wake of petitions filed by several private schools, in which the affected students had studied. Recently, state school education board had ordered to demote 3,125 class XI students to class IX. All such students had had passed their class X from the board.

The board had also asked the private schools to register an FIR against all such students for procuring fake school leaving certificates. As per the allegations, these students had taken admission in class X on the basis of school leaving certificate of class IX from schools outside the state. Earlier, the board had allowed them to appear in class X examinations, but later it found their school leaving certificates pertaining to class IX fake and ordered to demote them.

Challenging the board’s move, the petitioner schools had been arguing before the HC that decision to cancel students’ admission at a time when they had qualified class X examinations was irrational and arbitrary. It was also submitted that the school leaving certificates of the students were verified by the officers of state education department and canceling them would prejudice their future.

Petitioner schools had also submitted before the court that the board’s directions to file complaint against students for forgery was also not justifiable as they couldn’t be complainant against their own students.
