Pay compensation to former militant, killed by gunmen, HC to govt

Jammu and Kashmir High Court has directed the state government to pay compensation to next of kin of former militant who was killed by unidentified gunmen in south Kashmir district of Anantnag in 1994. The court issued the order on a petition filed by the family members of former militant Abdul Hamid Makroo after government failed to implement the order of State Human Rights Commission (SHRC), directing government to pay compensation and employment to one member of victim family.

Chief Justice N Paul Vasantha Kumar directed the state government to follow the SHRC directions within eight weeks. Makroo was kidnapped and later killed by unidentified gunmen on September 13, 1994 in Anantnag.

The family member of Makroo, including his sister and father filed a petition in SHRC in 2009 seeking compensation after they could not get any relief from the government.

The SHRC who after considering the reports of the Police and other records recommended to the State Government to pay ex-gratia relief of Rs 1 lakh in favour of next of kin besides benefit of employment under SRO 43 of 1994. However, despite SHRC direction no action was taken by the government and the family members approached court.UNI BAS QAB RSA CS1124
