Contempt notice to basic education secretary
ALLAHABAD: The Allahabad High Court has deemed not filing of reply as contempt of court and directed that notices be issued to Secretary, Basic Education, UP. The court has fixed May 9, 2014 as next date of hearing.
Passing the above directive, Justice Bharati Sapru directed that the matter be placed before the court hearing contempt matters on May 9, 2014.Earlier, the court had passed an order on March 28, directing Secretary Basic Education to either file reply (counter affidavit) to the amendment application or to appear in person on April 15. When the case was taken up on April 15, however, the court found that no reply has been filed by the secretary, nor has he cared to appear in person in compliance with the order of this court dated March 28.
Passing the above order, the court observed “this is gross contempt of the order dated March 28, 2014 passed by the court, especially in view of the fact that the state counsel, who is present before the court, has produced a fax message sending report showing that the fax was earlier sent to the secretary on March 29, 2014.”
